Child-friendly approach is changing the face of Family Law
CARMEL, IN – September 22, 2008 – Attorneys in the Family Law Practice Group of Jocham Harden Dimick Jackson, PC recently completed training in collaborative law, a method of family law practice that stresses the interests of children and promotes cooperation among the parties rather than confrontation in the courtroom. Holly Wanzer, Elisabeth Edwards and Stephenie Jocham, a founding member of the firm, are also registered domestic mediators who are promoting awareness about this option for people seeking divorces or sorting out child custody and other sensitive issues.
Collaborative law is a relatively new form of dispute resolution, pioneered by Minneapolis family lawyer Stuart G. Webb. Primarily used in divorce as a means of resolving issues privately while minimizing conflict and bitterness, it is gaining in popularity. In collaborative divorce, the separating couple and their attorneys pledge at the outset to try to work things out through consultation and open communication, using lawyers and sometimes other experts to assist in the details. They all pledge in advance not to go to court or use the information shared in collaborative discussions in litigation. Parties have more control to work out settlement details and find creative solutions for their problems, which they understand better than any judge or third party. Positive outcomes are best reached through respectful communications, not courtroom battles.

CARMEL FAMILY LAW ATTORNEY NAMED TO INDIANAPOLIS BAR ASSOCIATION’S BOARD OF DIRECTORS
CARMEL, IN – September 18, 2008 – Attorney and Domestic Mediator, Elisabeth M. Edwards was named as an at-large member for a two year period, serving 2009-2010.
Ms. Edwards is an attorney in the Family Law Practice Group of JOCHAM HARDEN DIMICK JACKSON, PC. In addition to focusing her practice on all areas of family law litigation, Ms. Edwards is also a registered domestic mediator. A 2002 graduate of Indiana University School of Law-Indianapolis, she is a frequent lecturer and seminar presenter on diverse topics in family law addressing children’s issues and property distribution as well as legal education for paralegals.
Ms. Edwards’ professional career involvements include the Protective Order Pro Bono Project of Greater Indianapolis, Inc. for which she has served in several capacities, including the Board of Directors. She has also completed specialized training and currently serves as a court-appointed Guardian Ad Litem. Ms. Edwards’ is a member of the Indianapolis Bar Association, Family Law Division as well as the Bench Bar Committee and Pro Bono Standing Committee. The question of disposition of items given as gifts frequently comes up in divorce cases. The Indiana Court of Appeals addresses this issue involving a vehicle in the matter of William A. Brackin v. Peggy J. Brackin, No. 05A02-0803-CV-218. In a case of first impression, the Court agreed with the lower ruling that the husband gifted a car to his wife, despite registering the title in both parties’ names. In this case, the parties had executed a premarital agreement which included a section on interspousal gifts remaining the gift of the “donee spouse.” Evidence in the Brackin case showed that husband’s intent was that the car was a gift to wife and that wife had primary use and possession of the car during the marriage. We appreciate everyone’s patience during the construction of our permanent offices at 11450 N. Meridian Street, Suite 200, Carmel, Indiana 46032. We eagerly anticipate our projected move to the new facility the second week of September. Our temporary offices have certainly been useful, but we are bursting at the seams and are excited about the opportunities that our new space will provide for enhancing our services.
